Tax Appeal Filing Deadline Extension Due to COVID Emergency

    June 11, 2020

***UPDATE***On May 28, 2020, Governor Murphy signed P.L. 2020, c. 35 into law. This law extends the filing deadline for property tax appeals in counties operating under the “traditional” assessment calendar to July 1, 2020. Counties operating under the alternate assessment calendar (currently Monmouth and Gloucester Counties) have not had their filing deadline for appeals at the county boards of taxation extended beyond the original January 15, 2020 date.

April 30, 2020 - Due to the federal, state and public health emergencies arising from the COVID-19 coronavirus pandemic, the Supreme Court of New Jersey issued an order on March 19, 2020 (see link below) EXTENDING the filing deadline for tax assessment appeals (to the extent they have not already run out) to the later of May 1st, 2020 OR thirty (30) days following a determination by the Governor of New Jersey that the state of emergency declared under Executed Order 103 has ended. The Supreme Court of New Jersey issued subsequent clarifying orders on April 7, 2020 and April 21, 2020 (see links below) confirming the assessment appeal filing deadline extension order applies to 2020 judgments issued by the Monmouth and Gloucester County boards of taxation as well as to municipalities undergoing a district wide reassessment or revaluation.

This filing deadline extension applies to the Tax Court of New Jersey and to all county boards of taxation. The assessments of all properties in every county in the state may also be appealed to the state Tax Court of New Jersey (as per the extension provided in the Supreme Court’s order) IF their 2020 assessment is in excess of one million ($1,000,000) dollars. If you feel your residential, retail, commercial or industrial property is over-assessed, please contact Justin McCarthy for a no cost initial review and discussion.
