    GH&C Attorneys Win Builder's Remedy Case Against Livingston Township

    September 24, 2010, Red Bank - Paul H. Schneider, shareholder of the law firm of Giordano, Halleran & Ciesla, and Craig M. Gianetti, an associate with the firm, prevailed in a builder's remedy lawsuit against Livingston Township. The GH&C lawyers asserted that Livingston failed to satisfy its obligation to provide its fair share of affordable housing as required by New Jersey's Mount Laurel doctrine. They contended that Squiretown Properties, LLC should be awarded a builder's remedy, allowing it to build a multi-family development on land Livingston had zoned for single family homes. Superior Court Judge Dennis Carey agreed and, following a three day trial, ordered that Livingston must allow Squiretown Properties, LLC to develop its property with a 220 unit inclusionary residential development.
