![]() September 1, 2011 - Community Trends - A recent court decision has limited the right of condominium unit owners to contest zoning changes in the vicinity of their units. Specifically, the Appellate Division of the Superior Court of New Jersey's ("Appellate Division") decision in Jennings v. Borough of Highlands, et al., 418 N.J. Super 405 (App. Div. 2011) held that a condominium association, rather than individual condominium unit owners, holds the authority to sign a landowners' petition protesting a proposed zoning ordinance pursuant to the provisions of the Municipal Land Use Law, N.J.S.A 40:55D-1 et seq.
