Giordano, Halleran & Ciesla, P.C. Attorneys Gain Approval To Develop Solar Farm


May 23, 2011 - Red Bank, NJ - Attorneys from Giordano, Halleran & Ciesla were successful in obtaining preliminary major site plan approval for their client, Solar Wind Energy, LLC, in Edison Township. The project consists of 16 megawatts of solar power to be generated on panels developed on 56 acres of landfill cover. The solar energy installation is located in an Industrial Zone and is ideally suited to provide power to the grid. The project involved very complicated regulatory issues concerning the landfill, the maintenance of the landfill operations, the development of the solar generating system, and its connection to the grid.

The reuse of the landfill for the solar power generation is a recommended policy of the State of New Jersey and the New Jersey Department of Environmental Protection. However, because of its location near the Raritan River, there were numerous and complex environmental regulations necessary to be satisfied along with meeting municipal requirements in gaining the approval of the municipality to permit the development.

John A. Giunco, Esq. presented the case to the Edison Township Planning Board. Mr. Giunco along with Vincent M. DeSimone, Esq. prepared the application, the presentation, and worked with witnesses and the developer to provide for a project that meets the objectives of Edison Township and the New Jersey State Energy Master Plan.
