The attorneys in the Real Estate, Redevelopment and Planned Real Estate Development Department guide developers, landowners, builders and lenders through the intricate regulations, requirements and policies governing the approvals and permitting process at the state, county and municipal levels. We have experience in every phase of acquisitions, financing, development, redevelopment, planned development and leasing.
Our attorneys work diligently on behalf of our clients on all land-related matters, including land and building acquisition and sale, redevelopment, and negotiations of purchase and sale agreements for commercial, industrial and mixed use developments and residential property, acquisition, construction and mortgage financing, land title and land ownership issues, preparation of offering plans and governing documents for planned real estate developments, as well as applications and development programs with the Council on Affordable Housing (COAH). We also have broad experience in renewable energy projects.
Our attorneys are experienced in all facets of redevelopment law including redevelopment designations, plans, agreements and acquisitions and approvals in connection with redevelopment projects. We understand the redevelopment process and the importance of a successful redevelopment from the perspective of all stakeholders. In connection with development projects, we have significant experience in working with municipalities in public/private partnerships. We have experience obtaining long term tax exemptions for redevelopment projects and successfully negotiating financial agreements with municipalities. Our experience includes redevelopment projects in downtown urban areas, transit villages, suburban areas and vacated office complexes and includes mixed use developments, as well as multi-family and commercial projects. We represent developers throughout New Jersey and are involved in among the largest adaptive re-use redevelopment projects in New Jersey and have significant and unique experience in the former Fort Monmouth property. We advise clients with respect to governmental and commercial financing, governmental assistance programs and other forms of financing.
Our Planned Real Estate Development attorneys have a keen understanding of the different legal requirements for each type of planned community. They have assisted in the development of a variety of planned unit developments such as active adult and retirement housing, golf course and resort communities, hotels, mixed-use projects, professional and commercial office complexes, industrial parks and apartment building conversions. Dwellings in these communities include fee-simple single-family units, townhouses, flats and office suites. We have experience in all facets of Department of Community Affairs registration including the following areas:
- Preparation of the governing documents and oversight of the registration of public offering plans as regulated by the New Jersey Department of Community Affairs
- Preparation of the related materials necessary for the registration of public offering statements
- Preparation of the governing documents for the homeowners or condominium associations established by the creation of mixed-use, active adult or large residential planned real estate communities.
The firm also has a sophisticated and experienced leasing team that is alert to the nuances of leasing documents. Our attorneys prepare and negotiate leases on behalf of both landlords and tenants including complex and general land leases, office center leases, shopping center and retail leases, along with single purpose leases, government agency leases and leases for mixed use projects.
Our attorneys are members and involved in the New Jersey State Bar Association Land Use and Environmental Law Sections. They are also members of the Monmouth County Bar Association, the New York State Bar Association, the American Bar Association, the New Jersey Builders Association and the Shore Builders Association of Central New Jersey.
