Insurance Coverage for Junk Faxes Is Question for Jury, Appeals Court Says

August 1, 2011, New Jersey Law Journal – Michael J. Canning was the quoted in a recent article by the New Jersey Law Journal discussing whether insurance coverage is applicable for junk faxes. Mr. Canning defended Group C Communications. “ The issue on which coverage depended — whether the policyholder's "primary, essential, chief or principal" business was "advertising, broadcasting, publishing or telecasting" — is for the trier of fact, not a matter for summary judgment, the Appellate Division ruled in Penn National Insurance Co. v.
